Dispute Resolution
C&D litigators provide practical, results-oriented dispute resolution and/or litigation services for our clients. We have the experience necessary to resolve challenging issues in a creative and cost-effective manner. We view our role as a business advisor for our clients seeking to assist them in resolving their particular dispute through the leverage we can provide as experienced litigators. C&D uses litigation, or the potential of litigation, as means to an end, i.e. a favorable resolution of our client’s dilemma. We listen to our clients and develop strategies to accomplish their goals and, when appropriate, seek to resolve disputes through the use of alternative dispute resolution mechanisms (e.g. mediation, arbitration) and, when necessary, litigation in state and federal courts or administrative agencies.
C&D litigators have represented clients, both at the trial and appellate levels, in state and federal courts in Massachusetts, and throughout the United States, and have appeared before administrative agencies, including the Equal Employment Opportunity Commission and the Massachusetts Commission Against Discrimination. C&D litigators recognize the importance of obtaining or blocking injunctive relief to create incentives to resolve disputes early in the litigation process thereby avoiding much of the disruption and expense of protracted litigation, and we have successfully so used injunctive relief to our clients’ benefit.
C&D litigators have extensive experience litigating contractual matters, minority shareholder actions, commercial disputes, unfair and deceptive trade practices actions, and all types of employment-related disputes, including claims of discrimination, harassment, breach of contract, constructive discharge and wrongful termination. C&D litigators have developed a specialized national practice representing institutions and key personnel in all aspects of the employee recruiting and departure arena, including litigating numerous injunction and damages actions in these employee transition disputes involving issues regarding post-employment restrictive covenants (non-competition, non-solicitation, non-recruiting, and non-disclosure), misappropriation of trade secrets or confidential information, breach of fiduciary duties and unlawful competition.
As an outgrowth of its real estate, estate planning and probate transactional practice, C&D also is well positioned to enforce its clients’ rights through litigation when disputes arise on these issues.
