Real Estate Transactions

C&D represents Sellers, Buyers, Investors and Lenders, both residential and commercial, in all aspects of real estate transactions transferring and/or re-financing properties.  C&D attorneys have handled thousands of real estate transactions on Cape Cod since the 1970s. 

 

C&D knows that the sale or purchase of a residential home or other real property is likely one of, if not the most, lucrative or expensive single transaction(s) that you will have in your lifetime.  It also tends to be a highly personal and emotional time given that it is more than a pure business transaction.  We are here to reduce your stress about the process and take the “legal-ese” out of the transaction. C&D attorneys have represented clients in thousands of real estate transactions so our expertise will result in a positive home selling or buying experience for you.

C&D’s representation of a Buyer generally involves some or all of the following:

​

  • Negotiate and Draft an Offer to Purchase

  • Negotiate and/or Revise a Purchase & Sale Agreement 

  • Examine and Certify the Title to the Subject Property

  • Obtain Title Insurance for the Lender and/or Buyer

  • Obtain necessary documents for closing (e.g. plot plan, municipal lien certificate)

  • Prepare a Declaration of Homestead as applicable

  • Ensure the closing documents are in order and explain them to Buyer

  • Obtain necessary signatures on all closing documents

  • Obtain and release all funds necessary for the completion of the transaction

  • Record all necessary documents at the appropriate authority (e.g. Registry of Deeds) 

  • If necessary, create set asides for escrow and release from escrow upon completion of the condition.

C&D’s representation of a Seller generally involves some or all of the following:

​

  • Review of an Offer to Purchase

  • Draft and Negotiate a Purchase & Sale Agreement 

  • Obtain Mortgage Payoff(s)

  • Prepare Necessary Seller-Side Legal Documents for Closing (e.g. Deed, Trustee Certificate, Limited Power of Attorney)

  • Obtain Seller’s signatures on necessary closing documents

  • Obtain and distribute funds due to Seller at the completion of the transaction

  • If necessary, create set asides for escrow and release from escrow upon completion of the condition
